<p>When you’re selling a home you have to appeal to the emotions of the potential buyer as well as their financial desires.  If your home has absolutely no furniture in it you may find that the potential buyer spends more time on trivial things like chipped paint, spots on the carpet and cracks in the plaster.  They notice unmatched patches from where paintings were and the way the carpet is more worn in one area than in others.  These trivial things are things that, if there were furniture in the home to distract their attention a bit, they probably wouldn’t even notice; but without furniture they stand out quickly.</p>
<p>Of course obvious problems like a huge crack down a wall is going to be noticed with or without furniture; but if you have all of the paintings and decorations hanging on the walls when they’re looking they’re going to see the style and accents of the home instead of the outline of where the paintings were.  They won’t be seeing where the walls are faded and thinking ‘this room definitely needs painted’ and adding it to the check list of work they’ll need to do to make this their perfect home.  If you have a couch and chair they’re not going to notice where the wearing of the rug may be as it’s pretty rare buyers will pull furniture out to look under and behind it.  Those small paint chips at the baseboards from typical wear and tear aren’t going to be as noticeable.  They’ll be busy seeing how well you fit in an entire dining room set along with a large china cabinet and a small accent table into the dining room, realizing how big it is as opposed to seeing it appear smaller and wondering if it will fit their entire dining set.<br />

To a buyer looking at an empty room they see ‘work that needs to be done on the home’ and ‘uncared for little things’ as opposed to when they move into it seeing the house empty for the first time when they’d call these same issues a few simple fixes for the “Honey Do List”. </p>
<p>A room filled with furniture is much more “homey” and inviting than an empty, voice echoing house.  It’s so much easier to find warm feelings and a welcoming atmosphere in a house that feels lived in with furniture and some personal surroundings.  Many people actually rent furniture; staging their home to make it look lived in.  Doing this puts more emphasis on the coziness of the home as opposed to the little imperfections.  It’s a proven fact that a home will sell faster when it feels inviting and lived in, so it may be worth raiding your family room and doing without a few seats or renting a few rooms of furniture for a month while you have Open Houses and are trying to sell your home.  You want the potential buyers to easily picture their family in your home, so making sure your house is staged to look lived in.  Give the potential buyers an old fashioned, welcome home feeling the minute they walk in.</p>

<p><strong>Here is the answer to Paul&#8217;s Question</strong>: In most cases your lender will pay those property taxes. Property taxes are a first priority lien on a property.</p>
<p>That means that if a property is foreclosed upon, then they still have to be paid. They don’t go away for any reason.</p>
<p>This is also why most lenders want to charge you monthly and then pay the property taxes themselves. They know that the taxes are a big bill that only comes once a year.</p>
<p>Not everyone can afford that big bill. Because your lender knows they will still have to pay the taxes after a foreclosure, they are willing to pay them during a short sale.</p>
<p>A foreclosure is a liquidation of the property to simply get what they can and move on. A short sale has been proven to net them more money than a foreclosure.</p>
<p>So if they are liquidating the property, why net more money from the sale with a short sale and avoid a foreclosure? That’s why they will pay the taxes when you short sale.</p>
<p>Every short sale the Stop Foreclosure Institute has sold resulted in the lender paying the property taxes that were owed. In some cases they paid 2-3 years of property taxes. Thinking about a short sale?</p>

<p>Use your rights as a homeowner to get more information about the BPO. An inaccurate BPO is the number one reason short sales fail.</p>
<p>Getting your hands on a copy of the BPO will help your agent contest an inaccurate BPO. And it would be a big help in any future lawsuit. Here is the step by step strategy:</p>
<p><strong>1. Request a complete itemized payoff from the foreclosing lawyer.</strong> In addition, request a copy from the lender themselves. You do this by faxing them a request. Usually you will get an answer in 7-10 business days.</p>
<p><strong>2. Review the payoff to see where the BPO is itemized</strong>. If a BPO has ever been ordered, it will most likely by itemized on there. If not, it may be included in some other payoff cost. Get confirmation of that in writing from the lender.</p>
<p><strong>3. Since the BPO is added onto the amount owed by the homeowner, they have a right to a copy under the Equal Credit Opportunity Act.</strong> Fax the lender&#8217;s legal department a request for a copy of the BPO.</p>
<p>Send a copy of the payoff and circle the spot where you think the BPO payment is. Request a copy for the borrower under the Equal Credit Opportunity Act. In addition, also mail the lender&#8217;s legal department the same request.</p>
<p>If the lender does not comply, then you can file a complaint with the Federal Trade Commission at www.ftc.gov, The Office of Thrift Supervision at <a href="http://www.ots.treas.gov/">www.ots.treas.gov</a>, the FDIC at www.FDIC.gov, and the Comptroller of the Currency at <a href="http://www.helpwithmybank.gov/">www.helpwithmybank.gov</a>.</p>

<p><strong>Example #1: Not giving buyers an answer on a short sale within one week.</strong> Home buyers don’t like to wait 3-6 months for an answer on a short sale. This fact causes many buyers to shy away from short sales, thereby causing short sales to sell for less.</p>
<p>Lenders should help the loan owners recoup as much money as possible from short sales. To do this, they make the short sale approval process as quick as possible.</p>
<p>They could start the property valuation process when the property is put on the market and determine a certain price they would accept.</p>
<p>More buyers would be willing to purchase the property because they know they wouldn’t have to wait 3-6 months for an answer on the short sale.</p>
<p><strong>Example #2: Turning down loan mods that amortize at a higher value than what is netted on a short sale or thru REO. </strong>Let me explain a little better. A lender negotiates a loan mod with a borrower with a new monthly payment of $1,000.</p>
<p>The borrower has a stable income and agrees to pay $1,000 a month for the next 30 years. $1,000 a month for 30 years, at a 6.5% interest rate will repay a $158,210 mortgage.</p>
<p>The servicer turns down the loan mod and forecloses. The house sells for $125,000 as an REO and the servicer nets $115,000. Did the owner of the loan lose money?</p>
<p>I think most people would agree yes. Obviously there are other factors involved, but I think on an actuarial basis they will do better with the loan mod.</p>
<p><strong>Example #3: Not following up on foreclosures properly. </strong>I have seen countless examples of servicers hiring an attorney to foreclose on a house. The attorney files the paperwork.</p>
<p>Then, the foreclosure case goes into purgatory. Nothing happen for 6 months, 12 months, 18 months, and even up to 2 years.</p>
<p>I have seen this happen on more than one property. And no, there are not other factors involved. In fact, on two short sales I&#8217;ve handled, the sellers had moved out of the house before the foreclosure was even filed.</p>
<p><strong>Example #4: Not listing REO properties quickly enough. </strong>I have witnessed several examples of banks foreclosing on a house and then taking 6 months to a year to put it up for sale.</p>
<p>An example is a house that was foreclosed on September 9th, 2009. It wasn’t listed for sale until May 2010. Say what you want, but waiting 8 months is pathetic.</p>
<p>If the mortgage holder had been a wealthy individual who lived in town, do you think they would have put the home on the market a little sooner?</p>
<p>These are the clearest examples I can think of right now. <strong>When you multiply these examples of negligence across hundreds of thousands of defaulted mortgages, you can easily see how this is costing lenders billions of dollars. </strong>Thinking about a short sale?</p>

Here was his question.</p>
<p>&#8220;I am looking to buy a short sale. The seller wouldn’t accept my offer. My agent told me it was because the short sale lender has told them they wouldn’t accept the offer.</p>
<p>I am a cash buyer and can’t understand why they wouldn’t take my offer. Why do some buyer’s offers get accepted while others are declined? Jonathan.”</p>

<p><strong>Here is the answer to his question. </strong>Usually the offer that is accepted is the one that is offering the highest sales price.</p>
<p>Sure banks and short sale lenders like cash offers. But, that is only everything else is the same. They won’t accept a cash offer when it is lower than other offers on the table.</p>
<p>Here is an example. A normal homeowner is selling their house. It is worth $400,000 and he is asking $400,000 for the home.</p>
<p>A buyer offers $350,000 cash. “You should accept my offer because it is cash”, the buyer says. Meanwhile another buyer offers $400,000 and they have already been approved for a loan.</p>
<p>If you were that seller, what would you do? Would you take a little risk to make an extra $50,000? Most people would. In fact, there isn’t much risk because the buyer has already been approved for a loan.</p>
<p>Yes, cash does matter. But, these banks want to reduce their losses as much as possible. They are already losing tens and hundreds of thousands on a short sale.</p>
<p>They own these homes cash. They don’t have to get their money out right away. They like cash offers, but they like to reduce their losses even more.</p>

<p>The lenders know that most bankruptcies will cause them to lose the ability to pursue you for any losses. This means they can’t go after you for any upside down debt.</p>
<p>The only thing a lender gets in a Chapter 7 Bankruptcy is any collateral they have on a loan. So they can foreclose on your house, but that is about the only thing they can do.</p>
<p>They can’t garnish your wages or bank accounts. So use the bankruptcy threat in your negotiations. Lenders know how much it will hurt their ability to collect from you.</p>
<p>The most effective technique that we have seen is to have all negotiations go thru a bankruptcy lawyer. The lawyer knows how to negotiate from a position of power.</p>
<p>The lawyer will also know full well exactly how bankruptcy will hurt the lender. Even if you have no intention of declaring bankruptcy the lender will get scared and cave in.</p>

<p>Dunedin FL – We received a lot of feedback from yesterday’s post.</p>
<p>One agent said, “You obviously don’t know what you are talking about. Bank X won’t give us a response on the file and we have been waiting 5 months for an answer.</p>
<p>How dare you suggest that I am incompetent because they haven’t replied?” (The bank was a large national bank whose name I changed for this post.)</p>

<p>First off, we are not saying that all agents are incompetent. However, we do see some agents with no experience with short sales attempting to sell them.</p>
<p>Here is the issue. Banks do have responsibilities. In 80% of cases, the bank we negotiate with does not own the loan. That means they don’t take any of the loss from short sales that aren’t handled properly.</p>
<p>In order to reduce losses, the people that do own the loans have laid out specific guidelines. Those guidelines state exactly how the bank should process the short sale.</p>
<p>In addition, they give deadlines for how long it takes to process the file. For example, VA gives 45 days for a bank to process and approve or deny a short sale.</p>
<p>If the bank doesn’t meet that requirement, then they can be fined by VA or lose their Mortgage Servicing Rights. By the way, those rights are worth $1,000 to $5,000 per loan they handle.</p>
<p>We hold banks accountable on short sales. It is their job to handle the short sales quickly and competently.</p>
<p>If they don’t do their job, then we let the people that own the loan know about it. Thinking about a short sale?</p>

Dunedin FL – I recently saw an article written by a prominent, so called short sale expert. In the article, this supposed expert says the only rules for short sales are HAFA, but even those rules are subject to interpretation.</p>
<p>ould drive 100 MPH and never get a ticket.</p>
<p>That is like saying that the court system has no rules. (Go ask a judge or lawyer and you’ll find out the truth about that pretty fast.)</p>

<p><strong>The good news for short sale sellers is that there are rules. </strong>There are lots of rules in fact. These rules protect you from renegade, rogue employees at short sale lenders. They also protect you from the lenders.</p>
<p><strong>Here is a small sampling of the rules and guidelines for short sales. </strong></p>
<p><strong>FHA Short Sales.</strong> There is a 16 page directive from HUD to lenders. This directive gives explicit instructions to all lenders on how to handle short sales on FHA loans.</p>
<p>You can read thru the rules for an FHA Short Sale yourself. Just Google “Mortgagee Letter 2008-43.”</p>
<p><strong>VA Short Sales.</strong> VA gives explicit instructions (again in their short sale guidelines. Only, they don’t call it a short sale. They call it a VA Compromise Sale.</p>
<p>Call a VA Loan Center to get a copy of the Compromise Sale Guidelines. Between 65-70% of all the loans in the US are owned or insured by one of the following entities: FHA, VA, Fannie Mae, or Freddie Mac.</p>
<p>Those entities either own or insure against loss. That also means those entities have the right to dictate what can and cannot be done on a short sale.</p>
<p>The lender handling the negotiations has to follow their guidelines or face stiff penalties. Fannie May and Freddie Mac do not publish their guidelines to the general public. But, we do know they have them.</p>
<p>The lenders have sent Stop Foreclosure Institute Members copies of their guidelines before. The member was disputing something on a short sale. They couldn’t believe a certain rule.</p>
<p>The lender’s negotiator sent them the guidelines for the thing they were disputing. The bottom line is that most (if not all) short sale sales do have rules.</p>

<p>Dunedin FL – Many people are shocked that it is often cheaper to short sale and rent that staying in your home with a loan modification.</p>
<p>They find it hard to believe that they can rent a comparable or even nicer home for less than their mortgage. Here are the two factors that make it possible.</p>

<p>Many homeowners bought homes for more than they are selling for today. A perfect example is a homeowner that paid $150,000 for a home. His mortgage payment was around $1,500 a month.</p>
<p>He stopped paying his payments and moved to a rental. He found a nicer, larger home to rent for $850 a month. He had tried for months to convince his lender to modify his loan.</p>
<p>They wouldn’t drop the payments below $1,200 a month. Even though the home he is renting is nicer than his house, it is selling today for around $105,000.</p>
<p>Someone can buy that house for $105,000 and rent it for $850 a month without losing money. <strong>That is what makes it cheaper to rent versus getting a loan modification and staying in your home.</strong></p>
<p>When prices were rising it was actually more expensive to own versus rent. But, everyone wanted to own because their house was supposed to go up in value.</p>
<p>House prices and rental prices have dropped since then. Yes, rents are not at an all time high! The dropped during the economic crisis and have come back up since then.</p>
<p>So, if you are thinking about a loan modification, then first check into the rental market. <strong>You will be able to negotiate your loan modification from a position of power. </strong></p>
